Agreement

These terms govern your use of this website, fusionpayments.com, of our invoicing portal at invoices.fusionpayments.com, and of the Fusion Payments SMS messaging program described below. By using the site, or by opting in to messages, you accept them. If you do not accept them, do not use the site and do not opt in.

The site is information, not advice

Content on this site — including worked fee examples, ledgers, and projections — is illustrative. It is not legal, tax, accounting, or financial advice, and your own statement will differ. Figures marked illustrative are exactly that; the honest number comes from reading your statement, which is what we offer to do.

Who we are

“Fusion Payments” is a trade name of Generosity LLC. Where these terms say “we” or “us,” they mean Generosity LLC.

Generosity LLC, dba Fusion Payments, is a registered Independent Sales Organization of Wells Fargo Bank, N.A., Concord, CA. Merchant accounts are issued, and card transactions are settled, by the sponsor bank and its processors and gateways — principally Fiserv. We sell, board, and service those accounts as the bank's registered agent. Approval of any merchant account rests with the bank, not with us, and the processing agreement a merchant signs is with the bank and its processor.

Services are sold by agreement, not by webpage

Merchant services, payment processing, and website design and hosting are provided under separate written agreements signed by both parties. Nothing on this site is a binding offer, a rate quote, or a guarantee of approval, savings, or outcome. Program availability and pricing depend on underwriting, your state, and card-network rules.

SMS messaging program

Fusion Payments operates a transactional SMS program. Messages are limited to invoice notifications, billing alerts, and payment receipts. It is not a marketing program, and agreeing to it is not a condition of purchasing any good or service from us.

There are three ways to opt in, and each of them takes a deliberate act. On our application form at fusionpayments.com/signup, by entering your mobile number and checking a box that is not pre-checked. In our invoicing portal at invoices.fusionpayments.com, where a business that records the mobile number of one of its customers must confirm, on a box that is not pre-checked, that the customer agreed to receive invoice texts from that business — without that confirmation the number cannot be texted. Or by texting START to our messaging number. Message frequency varies with your account activity. Message and data rates may apply.

Reply STOP to any message to cancel; you will receive a single confirmation and then no further messages. Reply HELP for help, contact us at the phone number or email address in the footer of every page, or submit a request on our opt-out page. Delivery is subject to carrier transmission and is not guaranteed, and mobile carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

Mobile information is handled under our Privacy policy. In particular, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties.

Reviews and case records

Reviews on this site are reproduced from public sources, in full and unedited, and were not compensated. Case records are published only with the sign-off of the client they describe.

Intellectual property

The content, design, and code of this site belong to Fusion Payments or its licensors. You may read it, link to it, and quote it fairly with attribution. You may not republish it or pass it off as your own. Automated retrieval of these pages for lawful compliance, regulatory, or carrier-vetting review is expressly permitted; bulk copying for other purposes is not.

Acceptable use

Do not use this site to send spam, probe or disrupt our infrastructure, submit false information through our forms, or violate any law. We may block traffic that does.

No warranties; limitation of liability

The site is provided as-is and as-available. To the fullest extent permitted by law, Fusion Payments disclaims all warranties about the site and will not be liable for indirect, incidental, or consequential damages arising from your use of it. Nothing here limits liability that cannot lawfully be limited.

Third-party links

Where this site links to third-party sites or services, those are governed by their own terms and policies. We are not responsible for them.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue for any dispute about this website lies in Orange County, Florida.
